Terms and Conditions of Registration
Introduction:
1. In these terms of registration, unless the context requires otherwise, the following definitions apply:
- Australs means Australs 2010 Ltd
- Championships means the Australasian Inter-Varsity Debating Championships to be held in Auckland in 2010.
- Competitor means any participant in the Championships, including but not limited to debaters, judges, and observers.
2. These terms of registration are to be read in conjunction with the “The Registration Process”. In the case of any inconsistency, these terms shall prevail.
Deposits and registration fees:
3. Deposits are non-refundable and non-transferable. If a team pulls out, any deposit paid will not be returned, and will not be credited against the registration fee of any other team.
4. Registration fees are non-refundable, provided that if a team withdraws from the tournament after paying its full registration fee, the registration fee, less the amount of the non-refundable deposit, will be refunded at Australs’ absolute discretion if that team’s spot can be filled from the waiting list or from late registration.
Force majeure
5. Australs shall not be liable for failure to provide any service to you or any Competitors in the Championship as a result of circumstances beyond its reasonable control, including but not limited to cancellation by Australs, at its absolute discretion, of the Championships due to a pandemic, natural disaster, act of terrorism or other security threat, strike or other withdrawal of labour, the request of a competent government or local government agency, or for any other reasonable cause.
6. For the avoidance of doubt, in the event of any of the circumstances set out in cl 5 above, Australs shall not, so far as permitted by law, be liable to refund either deposits or registration fees.
Release from Liability
7. Any liability of any sort that Australs may incur to you or any Competitor in connection with the holding of the Championships, howsoever and by whosoever caused, and whether in contract, tort (including but not limited to negligence) or otherwise, is hereby excluded.
Indemnity
8. You and all Competitors in your team hereby fully indemnify Australs for any damage of whatever kind howsoever caused by you during the Championships (including but not limited to accidnetal, negligent and intentional damage) for which Australs is held liable by any other party (either in contract or tort or otherwise) or in respect of which any fine or penalty of whatever kind is imposed on Australs, and agree to pay to Australs the full amount of any damages (including but not limited to damages for consequential loss) or fine or penalty imposed in respect of such damage. You further agree to abide by the Australs 2010 Code of Conduct for the duration of the Championships.
Consumer Guarantees Act 1993
9. If you or any Competitor is acquiring the services of Australs in connection with the holding of the Championships for the purposes of a business as defined in the Consumer Guarantees Act 1993 (the Act), then you hereby agree that the provisions of the Act do not apply to the provision of those services.
10. If you or any Competitor is not acquiring the services of Australs in connection with the holding of the Championships for the purposes of a business, the Act may apply to the provisions of those services. Any rights you or any Competitor may have under that Act apply in addition to these terms and conditions, and nothing in these terms limit or exclude those rights.
Recording rights
11. All Competitors grant the Championships Organisers the right to make any recordings of them during the course of the Championships, and grants Australs full rights in respect of those recordings.
Jurisdiction and governing law
12. These terms and conditions, and any other contract that may subsequently come into being between Australs and any Competitor in respect of the Championships, are governed by the law of New Zealand
13. Competitors submit to the exclusive jurisdiction of the courts of New Zealand, and agree not to object to the exercise of jurisdiction by those courts on any basis.
